1. The Government of Sint Maarten (GoSXM) has received financing from the World Bank toward the cost of the Sint Maarten Wastewater Management Project and intends to apply part of the proceeds for consulting services under this request for expression of interest.
2. The Government of Sint Maarten (GoSXM), represented by the National Recovery Program Bureau (NRPB) is looking to select an experienced (international or national) firm for a consultancy service for the Review and Update of the National Wastewater Ordinance and the Strengthening of the legal, policy, and regulatory framework of the Wastewater sector in Sint Maarten. The overall objective of this consultancy is to provide the NRPB with the technical, legal, and financial expertise necessary to review, update, and modernize the National Wastewater Ordinance and the related secondary legislation and establish a sustainable, efficient, and well-regulated wastewater management sector for Sint Maarten. This will be achieved through the development of four interlinked core deliverables.
3. The consulting firm shall be responsible for delivering the outputs described below. It is imperative for the consulting firm to conduct a thorough diagnostic analysis of the existing legal, policy, and regulatory framework governing the wastewater sector. This critical assessment will be the basis of the development of the management model, updated policies, and contracting mechanisms. The outputs expected from the assignment are:
· Deliverable 1: Comprehensive diagnostic and baseline assessment
· Deliverable 2: Review and update the National Wastewater Ordinance and NDGM draft
· Deliverable 3: Comprehensive and financially viable wastewater management model, including a sustainable financing model
· Deliverable 4: Updated and robust wastewater policy and regulatory framework, including clear operator requirements
4. The detailed scope and deliverables of the assignment are available in the Terms of Reference (TOR).
5. The National Recovery Program Bureau (NRPB) now invites eligible firms (“Consultant”) to indicate their interest in providing the Services. Interested Consultant should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services. · Sector-specific experience: Minimum 10 years of international experience in the water/wastewater sector, with a strong focus on wastewater management, regulation, and utility reform.
· Legal, legislative and regulatory expertise: Documented success in advising governments on developing or reforming legal and regulatory frameworks for public infrastructure and services and for drafting the legislative items in this field with at least 3 similar assignments completed in the past 7 years.
· Financial modelling provenance: Direct experience in developing financial models and tariff structures for water/wastewater utilities.
· Transaction advisory: Demonstrable experience in supporting public authorities in PPP/concession transactions for wastewater or similar urban infrastructure, from tender preparation to contract signing.
These would form the shortlisting criteria.
6. The selection process will be undertaken in line with the World Bank’s “Procurement Regulations for IPF Borrowers” Fourth Edition November 2020 (“Procurement Regulations”) for open competitive selection. A Consultant will be selected in accordance with the Quality and Cost-Based Selection (QCBS) method set out in the Procurement Regulations.
7. The attention of interested Consultants is drawn to Section III, paragraphs, 3.14, 3.16, and 3.17 of the World Bank’s “Procurement Regulations for IPF Borrowers” (November 2020) (“Procurement Regulations”), setting forth the World Bank’s policy on conflict of interest.
