THE ODRA-VISTULA FLOOD MANAGEMENT PROJECT

Assignment Title: 

A program of non-structural and flood storage measures being an element of flood risk management in the Little Vistula and Upper Vistula water regions (the sub-basin upstream of Kraków) – Preparation of design documentation, including obtaining administrative permits and Author’s Supervision during implementation under the future Poland’s Building Climate Resilience in Water Management Project, including the preparation of bidding documents necessary to select contractors for future works.

The Government of the Republic of Poland has received financing from the World Bank for the implementation of the Odra-Vistula Flood Management Project (OVFMP) and intends to apply for new financing from the World Bank for a future project Building Climate Resilience in Water Management Project. In parallel, the Government has allocated sufficient state budget to support the preparation of this future project. This consultancy service is part of the preparation activities for the future project. The Government intends to use part of the preparation budget and the expected financing for the Building Climate Resilience in Water Management Project to hire consulting services related to the above-mentioned assignment.

The said consulting services (“Services”) will be provided to the State Water Holding Polish Waters (Państwowe Gospodarstwo Wodne Wody Polskie), Żelazna 59A Street, 00-848 Warsaw, Poland (“Client”) (correspondence and contact address: State Water Holding Polish Waters (Państwowe Gospodarstwo Wodne Wody Polskie – Regional Water Management Authority in Krakow, Marszałka Józefa Piłsudskiego 22 Street, 531-109 Kraków), based on a consultancy contract signed, on behalf of the State Water Holding Polish Waters, by the Director of the Regional Water Management Authority in Kraków with the selected Consultant.

The consulting services (“the Services”) include support to the Client in an effective and timely preparation for implementation of an investment project involving, among others, the preparation of a construction design and designs for the associated structures, including obtaining required administrative permits, for the investment entitled “A program of non-structural and flood storage measures being an element of flood risk management in the Little Vistula and Upper Vistula water regions (the sub-basin upstream of Kraków)”, as well as to support the Client in preparing and conducting the tender process to select a Works Contractor(s), Supplier(s) and other Service Provider(s).

In particular, the subject of this assignment is a service involving analysis of the documentation prepared at the Feasibility Stage (Conceptual Design), which is held by the Client and will be made available to the Consultant, and identification of the current baseline pre-investment situation, the preparation of a construction design and necessary detailed designs, technical specifications for the execution and acceptance of construction works, bills of quantities and cost estimates, a summary statement of costs, and a physical and financial schedule, obtaining necessary decisions and permits, including a construction permit(s) (an environmental permit(s), a water law permit(s), a construction permit(s), a road construction permit(s)), together with the preparation of necessary bidding, environmental, land acquisition, and social documentation in connection with the planned implementation of the investment project entitled “A program of non-structural and flood storage measures being an element of flood risk management in the Little Vistula and Upper Vistula water regions (the sub-basin upstream of Kraków)”.

The main scope of these consulting services involves the preparation of design documentation, bidding documents, documentation related to environmental measures and measures mitigating social impacts, updating and supplementing the geological and engineering documentation as well as other necessary documentation, and supporting the Client in the selection of a Works Contractor(s), Supplier(s) and other Service Provider(s). The Client also envisages the possibility of commissioning the Consultant to perform the service of author’s supervision over the execution of the Works based on the prepared design documentation, in compliance with the standards required by the World Bank, the provisions of law, and the FIDIC (after financing for the implementation of this investment project has been secured).

The expected duration of the Services is 18 months (the completion of the performance of the Contract is dependent on dates when individual administrative permits will be obtained, while ultimately on the acquisition of a Construction Permit).

The attention of Consultants is drawn to Section III, paragraphs, 3.13, 3.15, and 3.16 of the World Bank Procurement Regulations for IPF Borrowers; PROCUREMENT IN INVESTMENT PROJECT FINANCING Goods, Works, Non-Consulting and Consulting Services; Sixth Edition, February 2025, setting forth the World Bank’s policy on conflict of interest.

A Proposal for the Services shall be submitted in English language

The State Water Holding Polish Waters, Regional Water Management Authority in Kraków, invites eligible consulting firms (“Consultants”) to submit an Expression of Interest (EOI) in providing the Services.

Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services.

1.The Consultant should be legally and financially autonomous, operate under commercial law – entitled to enter into legal transactions, not dependent of (not under supervision by) the Borrower
2.Experience in implementing projects characterized by a high level of complexity, including projects implemented in local conditions with high saturation of infrastructural structures of technical, social, spatial as well as environmental and natural significance, having a key impact on meeting the collective needs of local communities, residents, businesses, service users, tourism, spa resorts, etc.
3.Experience in planning and preparing large water management projects, including designing and obtaining required decisions, permits, opinions and agreements, etc.
4.Experience in planning and preparing the construction of large hydraulic structures,  including designing and obtaining required decisions, permits, opinions and agreements, etc.
5.The Consultant should have at least 20 years of experience in designing hydraulic structures, including the preparation of at least three (3) sets of design documentation similar to this assignment with regard to Class I, II or III permanent water impoundment structures over the last 15 years before the deadline for submitting Expressions of Interest.The Client will consider the following services to be similar to this assignment:Preparation of a master plan or design documentation associated with the reconstruction, improvements, construction of storage reservoirs or flood protection structures (e.g. dry flood control reservoirs or polders), including hydraulic structures (i.e. main dam, outlet works and spillway), with a total reservoir storage capacity of at least 5 million m³. The required Class I, II or III of the structures to be designed should be in accordance with the Regulation of the Minister of Environment of April 20, 2007 on the technical requirements that hydraulic structures and their location should meet ( (Journal of Laws) 2007.86.579,).
6.The Consultant should demonstrate experience in designing documentation for 3 different structures referred to in point 5, constructed at the same time.

Consultants may associate with other firms to enhance their qualifications but should indicate clearly whether the association is in the form of a joint venture and/or a sub-consultancy. In the case of a joint venture, all the partners in the joint venture shall be jointly and severally liable for the entire contract, if selected.

The shortlist will contain five to eight firms.

Interested Consultants should submit the following:

  1. Information demonstrating that they have the required qualifications and appropriate experience to perform the Services, e.g.:
    1. Information on completed assignments;
    2. A general portfolio of the Consultant’s activities;
    3. Letters of reference;
    4. Awards, competitions – information whether the Consultant has received some distinctions.
  2. An Expression of Interest should be prepared English and submitted in writing, otherwise invalid.
  3. All documents and declarations composing an Expression of Interest should be signed by the persons authorized to represent the Consultant or empowered by such persons to represent the Consultant based on a separate power of attorney.
  4. If any of the documents defining the legal status of the Consultant(s) or any power of attorney shows that several persons are authorized to represent the Consultant, the documents must be signed by all such persons.  

A Consultant will be selected in accordance with the method Quality and Cost-Based Selection (QCBS) described in the Procurement Regulations and to be specifically set out in the Request for Proposals.

4. The recipients of your personal data will be persons or entities performing public tasks or acting on the order of a public authority, to the extent and for the purposes arising from generally applicable laws.

5. Your personal data will be transferred to the International Bank for Reconstruction and Development (World Bank) and entities to whom the bidding documentation will be made available in accordance with the Loan Agreement made on September 10, 2015 between the Republic of Poland and the International Bank for Reconstruction and Development (No. 8524 POL).

6. Your personal data will be stored for a period of 10 years from the submission of the EOI or 2 years from the date of expiry of the Loan Agreement of September 10, 2015 between the Republic of Poland and the International Bank for Reconstruction and Development (No. 8524 POL), whichever is later.

7. The obligation to provide your personal data directly concerning you is a statutory requirement specified in the provisions of the Public Procurement Law, related to participation in the public procurement procedure; the consequences of not providing specific data result from the Public Procurement Law.
