Objective and Purpose of the Assignment

 
 

To support the National Development and Reform Commission (NDRC) with their drafting of the national
ecological compensation (or eco-compensation) regulation of the People’s Republic of China (PRC) with
improved quality, aiming to (i) build on ADB’s joint comprehensive study with the NDRC on eco-
compensation regulations, which highlighted the need to capture the diversity of subnational
experiences; and integrate them into a coherent national regulatory framework; and more broadly build on
ADB’s long-term technical experience and partnership with the NDRC; and (ii) provide timely and relevant
policy advice while supporting research and building strong synergies with ADB’s investment programs in
the Yangtze River Economic Belt and the Yellow River Basin for enhanced environmental protection and
high-quality green growth.

Scope of Work

 
 

The TA consultants will report to the ADB project officer, through the assigned team leader, on day-to-
day activities; and coordinate with the assigned project officers of the NDRC, who in turn will
coordinate with the ministries and the State Council. All the TA consultants will be responsible for the
completion of their respective assigned tasks and the conduct of the TA activities to be coordinated
with the team leader for the following TA outputs:
(i) Output 1: Policy advice on the national eco-compensation regulation finalized. This output will
include (a) a review of subnational, national, and international policies and legal and regulatory
frameworks in relation to eco-compensation, payment for ecosystem services (PES), and market-based
instruments for ecological protection; (b) identification of key issues of eco-compensation and
development of the outline of the national eco-compensation regulation; and (c) preparation of the draft
national eco-compensation regulation; and the deliverable under Output 1 is the TA consultants’
inception report to be presented at the inception workshop which would cover the (a) technical desk
review of the (1) latest subnational polices on eco-compensation, and (2) a summary of relevant
international policy and regulatory frameworks on the PES with a focus on emerging markets; and (b) an
outline of the draft national eco-compensation regulation.
(ii) Output 2: Understanding on proposed national eco-compensation regulation increased. This output
will include (a) the conduct of consultative workshops combining with inception and interim workshops
with relevant stakeholders: the NDRC, line ministries, subnational agencies, local governments, and
civil society organizations. Consultations will be undertaken under the guidance of national and
international experts to discuss the draft national eco-compensation regulation and the thematic areas
proposed under the regulation; and (b) submission of the draft final national eco-compensation
regulation to the State Council for consideration and approval; and the deliverables under Output 2 is
the TA consultants’ draft interim report which would primarily cover the draft national eco-compensation
regulation to be presented at the interim review workshop for review and discussion with the NDRC and
relevant ministries and stakeholders; and
(iii) Output 3: Knowledge product published and disseminated. This output will include the (a)
preparation and publication of a technical policy paper both in English and in Chinese languages, with a
focus on key thematic areas proposed under the regulation, including but not limited to scope of the
regulation, eco-compensation mechanisms for key ecosystems, transboundary eco-compensation mechanisms,
and trading systems among market players; rights and obligations of ecosystem owners, direct users,
beneficiaries, and indirect users; local government responsibilities; obligations of stakeholders
engaged in eco-compensation, institutional coordination, and policy coherence; correlation between eco-
compensation programs and poverty alleviation; and relations between eco-compensation and functional
zoning; and (b) knowledge sharing and dissemination of results in the PRC and other developing member
countries of ADB through webinars and outreach knowledge products (i.e., policy briefs, blogs, opinion
from editors [op-eds], etc.); and the deliverables under Output 3 are the TA consultants’ draft final
and final reports which would cover the (1) revised draft national eco-compensation regulation for
submission to ADB and the NDRC for review and approval before submission to the high-level decision
makers for consideration; and (2) knowledge product to be developed under the TA in the form of a
technical policy paper for publication and dissemination to regional and international key stakeholders
in the PRC and the Asia and Pacific region through various knowledge sharing events and platform.

Detailed Tasks and/or Expected Output

 
 

The specialist will perform the following tasks:
(i) Serve as team member, working in close cooperation with the national environmental law specialist
and team leader and other team members;
(ii) Within the first 2 months after mobilization, review and analyze the international case studies
across various themes (e.g., eco-compensation mechanisms for key ecosystems, transboundary eco-
compensation mechanisms, and trading systems among market players; correlation between eco-compensation
programs and poverty alleviation; and relations between eco-compensation and functional zoning) and
geographies, with a focus on emerging markets relating to the eco-compensation thematic areas; and
prepare a thematic analysis report on the PES regulations (in 15–20 pages, with an executive summary in
3–5 pages) for inclusion in the inception report (Note: participation in all workshops via virtual
meetings);
(iii) Contribute relevant inputs; and assist in the review, revision, and finalization of the (a) draft
inception report; and actively participate as a speaker at the inception workshop within 2 months after
mobilization; (b) draft interim report and actively participate as a speaker at the interim review
workshop within 8 months after mobilization; and (c) draft final report and actively participate as a
speaker at the final review workshop within 12 months after mobilization (Note: two workshops via
virtual meetings and one workshop via face-to-face meeting, with provision for travel costs); and
(vi) Perform other tasks requested by the national team leader and the ADB project team leader that are
aligned with the objectives and scope of the work assignment.

Minimum Qualification Requirements

 
 

The specialist must have (i) at least a master’s degree in natural resources management and/or
economics, environmental economics, environmental management, or a closely related field; (ii) at least
15 years of professional work experience in natural resources assessment, natural capital accounting,
and economic cost–benefit and valuation analyses; (iii) in-depth knowledge of the PES and demonstrated
experience in conducting the PES analyses, including the use of software and tools for natural capital
accounting; (iv) familiarity with the PES schemes in emerging and developing economies; (v) familiarity
with the PRC’s eco-compensation and preferably previous working experience in the PRC; (vi) proven
record in the writing of research papers, policy analyses and recommendations, reports, and
publications, as required; and (vii) capacity development project-related experience in cooperation with
ADB and/or other international organizations, which is an advantage. The specialist’s expected output
within 2 months after his mobilization is a thematic analysis report on the PES regulations in 15–20
pages, with an executive summary in 3–5 pages.
